No Warranty

The Platform and Services, including all content, functions, and materials, are provided on an “as is” and “as available” basis without representations or warranties of any kind, express or implied, including without limitation, non-infringement, merchantability, or fitness for a particular purpose. ErrorLens does not warrant that the Services will be timely, accurate, secure, uninterrupted, or error-free, or that defects will be corrected. We make no warranty that the Services will meet your requirements or expectations. If you are dissatisfied with the Platform or any Services, your sole remedy is to discontinue using them. No advice or information, whether oral or written, obtained by you from ErrorLens or through the Services shall create any warranty not expressly made herein. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply.

Limitation of Liability

In no event shall ErrorLens be liable for any damages of any kind arising from your use of or inability to use the Services, including without limitation any loss of revenue, anticipated profits, lost business or data, or any special, incidental, or consequential damages, even if ErrorLens has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to certain users.

To the maximum extent permitted by applicable law, ErrorLens's aggregate liability for any claims arising under these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.

No Agency

You and ErrorLens are independent contractors, and no agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by this Agreement.

Third-Party Links and Integrations

Where ErrorLens provides links to, or integrations with, third-party services (including Jira, GitHub, Linear, Slack, PagerDuty, and others), no representations or endorsements are made in connection with such services. ErrorLens is not liable for any damages or injury arising from the use of such third-party services, or from the configuration or actions of your connected integrations. You are solely responsible for reviewing and complying with the terms of any third-party services you connect to ErrorLens.

Modification and Availability

ErrorLens may, at any time, modify, delete, or supplement the content of the Platform without prior notice. ErrorLens reserves the right, at its sole discretion, to terminate, change, suspend, or discontinue any aspect of the Platform or Services, including features or availability. ErrorLens may also impose limits on certain features or restrict your access to part or all of the Platform without notice or penalty. Where reasonably practicable, ErrorLens will provide 30 days' notice for material changes to the Services, except in cases of legal necessity or security incidents.

Service Integrity

ErrorLens makes reasonable commercial efforts to make its Services and Platform available at all times. However, ErrorLens is not responsible for any interruptions, including but not limited to interruptions caused by third-party infrastructure providers, scheduled maintenance, or events beyond our reasonable control.

Monitoring

You agree that ErrorLens has the right, but not the obligation, to monitor at any time, for any reason at its sole discretion, all material and content submitted to the Platform. ErrorLens reserves the right to disclose or refuse to process any material or information or to request removal of any content from the Platform.

Termination

Either party may terminate this agreement at any time. ErrorLens may terminate your account immediately for material breach of these Terms, including prohibited use. Upon termination, your data will be deleted within 30 days, except billing records retained as required by law.

Injunctive Relief

It is understood and agreed that, notwithstanding any other provisions of these Terms, breach of the provisions of these Terms by you will cause ErrorLens irreparable damage for which recovery of money damages may be inadequate. ErrorLens shall therefore be entitled to obtain timely injunctive relief to protect its rights in addition to any and all other remedies available at law or in equity.

Losses

We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the Platform.

Events Beyond Our Reasonable Control

We will not be held responsible for any delay or failure to comply with our obligations under these Terms if the delay or failure arises from any cause which is beyond our reasonable control, including acts of God, government action, internet outages, or failures of third-party infrastructure providers.

Waiver

If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms. Failure to act on a breach does not constitute a waiver of any right.

Severability

In the event that any provision of these Terms shall be unenforceable or invalid under applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision within the limits of applicable law.

Entire Agreement

These Terms of Service comprise the entire agreement between you and ErrorLens regarding your use of the Platform and supersede all prior agreements between the parties on the subject matter herein. All provisions regarding representations and warranties, indemnification, disclaimers, and limitations on liability shall survive any termination of these Terms.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. You agree, as we do, that any dispute, controversy, or claim arising out of or relating to this agreement, or the breach thereof, shall be submitted to the exclusive jurisdiction of the courts at Nagpur, Maharashtra, India. For users in the European Union, mandatory consumer protection laws of your country of residence also apply.
